Broward Marine and the Denison Family And the story of Lady Columbo


This year, History Fort Lauderdale’s annual fundraiser, History Makers, honors the MARINE INDUSTRIES ASSOCIATION OF SOUTH FLORIDA and special pioneers in boatbuilding FRANK AND GERTRUDE DENISON, recognizing their contribution in establishing our region as the yachting capital of the world.

Stuart was invited to contribute from a broker’s perspective having had a “first hand, front row seats to building with us as well as the time period that all of this occurred, you were able to see FROM YOUR PERSPECTIVE, the influence that this relatively small boat yard/builder impacted others across this industry”.

It was 1984. I had been a yacht broker for 4 years. It was a fledging industry back then. The largest yachts were about 100 feet. I might have sold a couple of yachts in the 50’ region! Too long ago to remember……. But there was an economic boom, of sorts, unlike what we have seen recently, but nevertheless the yachting business was about to “take flight”.
 
I had met a client a few years before with a 65’ Hatteras that wowed me as to its sheer size. The client wowed me as well. So knowledgeable, so educated, so mechanically inclined and so astute business-wise. He wanted a “bigger yacht”. There simply weren’t any to buy. The dollar was really strong against European currencies.

The good European shipyards (all two of them) were on a roll with American buyers. So, the client, his wife and I went together to visit Feadship in Holland and Abeking and Rasmussen in Germany. We had plans drawn for a “massive” new 120’ yacht.
In the summer of 1984, we met on his Hatteras in Newport, RI to discuss the way forward with a new 120’ Abeking. I was in seventh heaven. What a deal for a 25 year-old kid.  It had to be too good to be true. It was. The next week, as we were about to sign for the new yacht the dollar crashed and the price increased 25%. OUCH.

Being shell shocked, I didn’t quite know how to move forward. And then I had what could have been the most brilliant idea of my now 40-year career in the yacht brokerage business. I picked up the phone (we didn’t have cell phones then) and called Ken Denison. I didn’t know Ken then but had heard whispers that Broward Marine had a possible default on a “big” yacht. Ken confirmed it might be available but he needed to check with his parents. Frank Denison called me, said there were a number of interested people and I had better hurry.

My ever- trusting client came that afternoon in his little Cessna jet, looked at what was to be his new yacht and we made a handshake deal on the spot. You could do that with the Denison’s. The client loved the idea of building in America, I loved the idea of building a yacht two miles from my office and home and so then and there, LADY COLUMBO was born.

She was the largest aluminum yacht to be built in the USA, and I felt so proud to be a part of it. The 9 months it took to finish her were not easy but the Denison family, and especially Ken and I forged a trusting relationship that Ken and I enjoy 35 years later. Mike Busacca was in charge of the detailed carpentry in LADY COLUMBO; Mike and I work together still, in very different roles, but Broward Marine and the LADY COLUMBO put us all on the map. Most importantly, it was such a successful project for the clients they later moved on to bigger yachts, buying and cruising the world on a 125’ Feadship (he finally got his Feadship) and then building a 184’ Feadship and then to cruising the world on a 160’ sailing yacht that they twice rounded Cape Horn on, and still own today.
 
This is my story but there are countless others that must attribute their success to that little Ft Lauderdale shipyard that launched the yachting business in America for so many lucky people.

WHAT IS FORCE MAJEURE AND HOW DOES IT AFFECT A SALES AGREEMENT Guidance from Robert Allen Law

To that end, we have prepared guidance on how the industry’s standard contracts – for charters, purchases and sales – deal with unforeseen circumstances such as the Coronavirus.

Prior to the Coronavirus pandemic, many brokers, dealers, manufacturers, buyers, sellers, owners and charterers had transactions well underway and many are now uncertain as to what will happen to those deals as important dates inch closer and government restrictions grow more severe. Your contract’s force majeure clause is the key provision to understanding how risk is allocated due to a delay or cancellation caused by the Coronavirus.

What is Force Majeure?
Force majeure is a Latin term used within the law that means an unforeseeable circumstance that prevents a party from fulfilling their obligations under a contract. Not all force majeure clauses are created equally, however, and the effect of such a clause is entirely dependent on the language used in your particular agreement. Some force majeure clauses may allow for a temporary suspension of performance, while others may allow for immediate termination of the agreement, or both. It is important that you carefully read the force majeure clause in your contract to determine your rights and responsibilities under the agreement.

When reviewing any force majeure clause, it is important to note that not every clause will cover events such as the Coronavirus. This may be due to the approach that some drafters take or if the agreement was not reviewed by a capable attorney before execution. Although the words “Coronavirus” will almost certainly not appear in your agreement as a defined force majeure event, there should be language broad enough to encompass health pandemics...

SCOUT II BACK ON THE MARKET Now in Fort Lauderdale, en-route to the Mediterranean

Known for excellent sea-keeping, SCOUT II is back on the market. She is available for inspection in Fort Lauderdale until the end of March. She leaves for the Mediterranean in April where she will spend this coming summer.

Purpose-built for exploration by the British shipyard Brooke Marine in 1993, the original owner required a robust, world cruising yacht. While the yard looked to their commercial tug platforms to meet the tough seakeeping specification, the owner hired Terry Disdale for the external styling and interior decoration to ensure the project was built to true yachting standards.

Extended from 34m/111’ to 40m/130’ in 2018, she is beamy and stable, with excellent interior volume and deck spaces. She is powered by 3408TA Caterpillar engines and all key equipment and machinery has either been replaced or overhauled in the last two years. Her mast has been redesigned, the stern provides great access to the water and the remodeled bow with increased height and flair makes for dryer decks and larger tenders forward.

The interior is classic but light, a masterpiece of Disdale design. The upper deck features a huge sky lounge and office with outside dining and seating on the large sky lounge deck.  SCOUT II can sleep 9 guests in four staterooms on the lower deck and carries 9 crew. Asking $9,900,000 SCOUT II represents an excellent opportunity to acquire a serious and well proven explorer yacht.

The 28m I 93’ Sea Forever has the feel of a much larger yacht. Every inch of her internal volume is put to good use and her performance is equally impressive. Capable of reaching the most remote locations where supplies are not easily available, she carries 12,000 USG (45,000 liters) of fuel and has a 5,600nm range at 8.5 knots. With six yacht’s sold, including the 83m Amels Here Comes the Sun, the 85m Lurssen Areti, and the delivery of the 63m Hakvoort Scout II, Stuart has sold 33 yachts since 2015, averaging over 6 sales a year. The average sales time remains under one year, which is remarkable in the industry.

Other sales in 2019 include two sailing yachts, the iconic Ciao Gianni and the Oyster  Columbo Breeze. Stuart acted for the seller in all sales other than the sale of Here Comes the Sun.

NEW CENTRAL LISTING: M/Y SEA FOREVERRoom, range and efficiency

Stuart is pleased to announce the Central Listing of Sea Forever, the 28m all-aluminum custom Exploration Yacht built by the Vancouver-based ABD Aluminum Yachts and delivered in 2007. ABD is known for its meticulously built, stout expedition yachts.
Built to cruise in remote locations where supplies are not always accessible, the need for
room, range, storage and efficiency influenced the yacht’s design and build.

Sea Forever has a 7.2m beam and an imposing bow, rising one-and-a-half decks above the water. Designer Ed Fry incorporated the high, bulbous bow to improve fuel efficiency and reduce pitching. He commented that “She’s built to survive 20-foot waves without shipping water.”

Sea Forever leaves the smallest environmental footprint possible and equipment includes an industrial waste compacter, an aerobic biological sewage treatment system and fuel-efficient propulsion. The two Lugger 500-hp engines by Northern Lights enable Sea Forever to reach a maximum speed of 12 knots, and have nearly a 5,000 mile range at 10 knots. All essential electronics are duplicated on the delightfully large flybridge.

The interior by David Boudreau is finished in soft-hued, unstained maple and flat walls display the wood’s flame-like structure. The overall effect is subtle and airy enhanced by the large windows on all levels.
Sea Forever can accommodate 8 guests in three staterooms on the Main deck in addition to the Master suite on the Bridge deck. The master is completely private and features sizeable windows on port and starboard and a sizeable personal aft deck. Sea Forever consistently feels larger than her 216 GT.
Sea Forever carries two good size tenders and has an extended beach club with a large lazarette kitted out to store scuba gear.

Proven beyond doubt, after undergoing a full refit in 2018, she embarked on an extended cruise of the South Pacific with stops in the Perlas Islands, Panama, the Galapagos and the Marquesas Islands and French Polynesia.

She can sleep up to 12 guests in 5 staterooms including a raised master suite with private study, his and her bathrooms and a secluded forward-looking terrace. CLOSING 2019 WITH A BANG: HERE COMES THE SUN SOLD Stuart’s sixth deal in 2019

Exciting end-of-year news: Here Comes the Sun, the largest AMELS ever built, has been sold in an in-house Fraser deal with Stuart representing the Buyer. This is Stuart’s sixth deal in 2019, the second largest by LOA after the 85m LURSSEN Areti.

Built by AMELS as “The Head of the family”, Here Comes the Sun is a “celebration of the luxury experience at the highest level – a sublime combination of comfort, style and uncompromising design”.
The 83-metre superyacht is not only the largest AMELS yacht built to date but also the first AMELS 272 from the yard’s successful Limited Editions range. And the records don’t stop there. The design collaboration between AMELS, the exterior designer Tim Heywood, and the interior designer Andrew Winch goes back 30 years to the Jon Bannenberg days.

Built by experienced owners, the build was completed in only 2.5 years and delivered in 2017. At 2827 GT and counting six decks, Here Comes the Sun has more than 1,400 square metres (15,069 sq ft) of interior. The levels of finish, the lack of noise and the lack of vibration is remarkable throughout.
Among the most eye-catching features are a large Beach Club that opens on three sides, the Main Deck swimming pool and the Sun Deck party space with jacuzzi and open kitchen. Here comes the Sun carries a wide range of water toys, tenders and a huge waterslide from Sun Deck.
